We provide permanent and temporary recruitment services to clients looking to recruit personnel for their businesses. We also provide payroll services for contractors.

At Claret Recruitment Ltd we are committed to maintaining the trust and confidence of our service users and visitors to our website.

In this Privacy Policy we explain how and why we use your personal data, whether you are one of our Candidates and we are helping you to find a job, a Client to whom we are providing a service, a Referee and we are using your data in relation to one of our Candidates or a visitor to our website. We also let you know what choices you have with respect to information about you.

This policy applies where we as a data controller determine the purposes and means of the processing of personal data with respect to candidates, contractors, their referees, clients and our website visitors.

How we collect and use your personal data

CANDIDATES/ CONTRACTORS: We collect from you, information including personal data necessary to match you to the best possible employment opportunities and/or to actively search for a role on your behalf. Throughout the various stages of the recruitment process, we may collect further information necessary to assess your eligibility for a role. This information includes CV data, identification documents, educational records, work experience, employment status, immigration status, details of referees, your National Insurance number and financial information. You may choose to share other relevant information with us.

We may also collect information related to your health, diversity information or details of any criminal convictions and will do so only where appropriate and in accordance with local laws and requirements.

At times, we may also use your personal data for diversity monitoring, marketing and profiling. Where appropriate and practicable, we will seek your consent before undertaking some of these activities.

The legal basis for our data processing is our legitimate interests which are the provision of our service to you, the ability to assess your suitability for potential roles and to put in place employment contracts.

CLIENTS: As a Client of Claret Recruitment we may need to use information about you or individuals at your organisation in the course of providing our services. Personal data collected from you may include your name, job title, information contained in your communications and other such data that we would naturally come into contact with while liaising with you regarding your staffing requirements.

The legal basis for our data processing information about our Clients is our legitimate interest – namely the performance of a contract between you and us and/or taking steps to enter into such a contract and in order that we may manage our relationships and communicate with Clients, maintain records of those communications and promote our services to our customers.

THIRD PARTIES WHOSE DATA WE ARE PROVIDED BY CANDIDATES/ CLIENTS E.G. REFEREES: In the course of providing our Candidates with suitable employment opportunities, we may ask for the contact details of a Referee, so that we can get in touch with them in order that they may serve as a Referee.

The legal basis on which we process your data is our legitimate interests. We need to verify the employment history and qualifications of our Candidates, to ensure they are well matched with employment opportunities for which we are putting them forward.

WEBSITE USERS: We use cookies to collect a limited amount of data from our Website Users which we use to help us to improve your experience when using our website. This includes information such as how you use our website, the frequency with which you access our website, and the times that our website is most popular. We will ask your consent before collecting this data.

The legal basis for our data processing is our legitimate interests which are monitoring and improving our website and services.

Where we collect personal data about you

We collect personal data about you from the following sources:

  • Directly from you: information you provide to us while searching for a new opportunity and/or during the process of recruitment;
  • From an agent/third party acting on your behalf;
  • Through publicly available sources including LinkedIn and Various jobs boards;
  • By referral or word of mouth: e.g. you may have been recommended by a friend, a former or present employer or colleague
  • Where a candidate gives them to us in order for you to serve as a Referee
  • Automatically via cookies when you visit our website, in line with cookie settings in your browser

Where we store and how we protect your data

We will take appropriate technical and organisational precautions to secure your personal data and to prevent the loss, misuse or alteration of your personal data. These include taking appropriate measures to deal with any suspected data breach.

We will store all your personal data on secure servers, password protected personal computers and mobile devices, and in secure manual record-keeping systems.

You acknowledge that the transmission of unencrypted (or inadequately encrypted) data over the internet is inherently insecure, and we cannot guarantee the security of data sent over the internet.

Retaining your personal data

Personal data that we process for any purpose shall not be kept for longer than is necessary for that purpose. We will retain your personal data as follows:

  • For as long as we have reasonable business needs, such as managing our relationship with you and managing our operations;
  • For as long as we provide services to you and then for as long as someone could bring a claim against us; and/or
  • Retention periods in line with legal and regulatory requirements or guidance.

Notwithstanding the other provisions, we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

Who we share your personal data with

We may disclose your information to various third-parties as follows:

  • To third party service providers who perform functions on our behalf (including external consultants, business associates and professional advisers such as lawyers, auditors, administrators, accountants, insurers, technical support functions and IT consultants carrying out testing and development work on our business technology systems);
  • To marketing technology platforms and suppliers;
  • To third party outsourced IT and document storage providers where we have an appropriate processing agreement (or similar protections) in place;
  • In the establishment, exercise or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure
  • In the event of the sale or merge of the business Claret Recruitment Ltd, in which case the personal data of our customers will be one of the transferred assets.

CANDIDATES/ CONTRACTORS: Your personal data may be shared with various parties who initiate a search for personnel and where the job description or the available position matches your skills, experience and job interests. The purpose of which is to ascertain whether you could be a good fit for the available position. Your information may also be shared with individuals and organisations who hold information related to your reference or application to work with us, such as current, past or prospective employers, educators and examining bodies and employment and recruitment agencies

CLIENTS: Your personal data may be shared with a candidate or contractor for the purpose of reporting to you at interview or where a candidate or contractor has been employed and engaged by you.

WEBSITE USERS: Unless you specify otherwise, we may share your information with providers of web analytics services to help us improve the performance of our website

Automated decision-making

We do not carry out automated profiling.

International transfers of your personal data

To better match your candidate profile with current opportunities we may transfer your personal data to clients and partners in countries outside the EEA.

Our customer and candidate relationship management platform and accounting software are based in the US at this time. The European Commission has made an “adequacy decision” with respect to the data protection laws of the US. Transfers to the US will be protected by appropriate safeguards, namely the use of the EU-US Privacy Shield approved by the European Commission, a copy of which can be obtained from https://www.privacyshield.gov/.

We will only transfer data outside of the European Economic Area or EEA (i.e. the Member States of the European Union, together with Norway, Iceland and Liechtenstein) where it is compliant with data protection legislation and the means of transfer provides adequate safeguards in relation to your data, for example:

  • By way of data transfer agreement, incorporating the current standard contractual clauses adopted by the European Commission for the transfer of personal data by data controllers in the EEA to data controllers and processors in jurisdictions without adequate data protection laws; or
  • By signing up to the EU-U.S. Privacy Shield Framework for the transfer of personal data from entities in the EU to entities in the United States of America or any equivalent agreement in respect of other jurisdictions; or

Soft opt-in consent applies where you have previously engaged with us (for example by submitting a job application or CV, or registering a vacancy to be filled), and we are marketing other recruitment-related services. For most people, this is beneficial as it allows us to suggest other jobs to you alongside the specific one you applied for, significantly increasing the likelihood of us finding you a new position. For other types of e-marketing, we are required to obtain your explicit consent.
